Always going to be up to the Judge. If the tear causes a small "bump" in the sleeve it's a marked card and not legal. Usually double sleeving would prevent that but still - up to the judge per event.

My opinion:
Until in the hands of the recipient, the cards are yours and your responsibility. If a person is trading for a card in X condition and they arrive as Y, obviously it is not their fault and they wouldn't have traded for that value if at all having known these facts. Your option 2 (he just gets stuck with the Jitte) is not an option at all. You need to work out an agreement with the person you've traded. Maybe he's ok with a damaged Jitte, but only values it at $10 so you need to send additional trade to make up for it. Maybe he just wants to reverse the trade. Whatever the person decides, it should be completely their decision (to an agreeable extent).
Just reverse the situation and put yourself in the other persons shoes.

I actually play Burning Wish so the foil is intriguing, however I may hold out and see if I can find something closer to my needs rather than shiny wants =P Will definitely keep you in mind over the next couple days.

Was bragging on your site today and when a buddy went to sign up he never received a confirmation email to register the new account. I though it was just user error perhaps and tried to create one myself, only to run into the same issue.

Good to know you all will be keeping everything in order! 
While I'm sure you don't need any further justification of the matter, the user refereed to in the OP was one of the first traders I came across on this site and nearly drove me away from it. I handled it the best I could and went forward with DeckBox and have since come across many great people. Would be a shame to think users like the before mentioned could so easily dissuade people from using this site. So thanks for keeping on top of things.
